Considering that Apogee owns the IP rights, I think it's up to them.

Apogee = 3D Realms. There's a separate "Apogee" company who was working on 2D Duke games, I don't know what the status of that is. But yeah, Apogee the venerable developer is dissolved.

I'm pretty sure that the 2D Apogee is retaining the rights to the IP

It's probable that they'll retain rights to the games they're currently making, but considering that 3D Realms was working on DNF far (far far) longer than the new 2D Apogee has existed, I'd assume the IP itself is in a state of flux at the moment. Take2 probably has all the power here, they could take the existing assets (you can see some in-engine renders from former Black Isle artist Tramell "T-Ray" Isaac here, here, here and here) and pass them off to a different studio to finish. That seems reasonable.
