"The" is a tiny word or small word or whatever, so even in a title it's not capitalized unless it's the first word in a sentence, or if you're only saying the title.

I'm with Akima here - if it's the first word of the title, it should have the capital.

Nope. A quick check of written references to half-a-dozen band names starting with "the" all show "the" not capitalized except at the beginning of a sentence.

I'd suggest forming a band called the The, but it's probably already been done.
