How much of this is true and how much is BS? Couldn't Nintendo still be sued since they've already released it?

that's the first I've heard of it, but major electronics companies get sued all of the time

heck, if I remember correctly, Mac was sued by some guy claiming he invented the wheel used on iPods and got a lots of moneys

that's a pretty week case though
most of those songs just have similar nuances, not actually being the same song
might as well sue half of modern music, the appropriation of sound is quite obvious

example:   Fall Out Boy vs. !Panic at the Disco
