As it seems to be for personal use, none.  There's only a problem if it gets marketed commercially! 

Of course, "Midnight Hobo" may well become adopted as a term for homemade bourbon by all the readers of said blog, but there's nothing wrong with that!

I knew someone in the SCA who wanted to research how to make medieval liquors and couldn't find a legal way to run a still.

Looks like they're just taking vodka and flavoring it with a charred oak barrel.

Since the hooch is presumably bought commercially before they, um, process it, they're fine as long as they don't sell it.

Of course, that stuff isn't bourbon any more than me holding a Fleshlight between my legs would make me a girl, so...
