I'm not making moral judgements here. A 40 year old having sex with a 14 year old is not paedophilia.
It's creepy and weird and definitely unethical especially if the 40 year old is in any kind of position of power (which they almost certainly are, by virtue of their being 26 years older than the 14 year old). It's almost always going to be terribly damaging (emotionally if not physically) to the younger party but it is not, by definition, paedophilia.
