I must have misread, I thought he was referring to things not explicitly protected by the constitution, which religion is. Otherwise it is indeed very confusing although as we all know you can always tell a muslim from a christian by the beard, sikhs have turbans, hindus have marks on their foreheads and atheists are extremely crotchety.
